Sexual Battery

Sexual battery, also known as rape, is the unwanted touching of a person’s intimate parts or nonconsensual sexual intercourse. To prove that this occurred, a prosecutor must be able to show that the defendant touched the victim’s intimate parts while he or she was somehow restrained and that this was unwanted. The prosecutor must also show that the defendant did this for the purpose of sexual arousal.

Sexual battery can be a misdemeanor or a felony. Misdemeanor sexual battery cases carry penalties of up to 6 months in jail and a fine of up to $2000. Fines can be greater if the offending party is an employer. Felony cases can involve jail time of up to 4 years and fines of up to $10,000. Registration of Sex Offenders
